These Terms & Conditions govern your use of the Pixfra Australia website and your purchase of products from us. Pixfra Australia is operated by Brokering Dealer Pty Ltd (T/As Pixfra Australia), a business domiciled in Queensland, Australia (“we”, “us”, “our”). By using our website or placing an order, you agree to these terms — please read them carefully.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law (ACL) or any other law that cannot be excluded.

About us and eligibility

We are an Australian electronics retailer specialising in thermal and day/night optics. We sell genuine local stock and ship within Australia. To buy from us you must be at least 18 years old and able to enter a binding contract.

Products, descriptions and pricing

All prices are in Australian dollars (AUD) and include GST unless stated otherwise. We take care to describe and price our products accurately, but errors can occur. If we discover an error in the price or description of an item you have ordered, we will contact you and give you the option to proceed at the correct price or cancel. We may update products, descriptions and prices at any time before your order is accepted.

Your order and our acceptance

When you place an order you are making an offer to buy. The contract between us is formed when we send you an order confirmation or dispatch your goods, whichever happens first. We may decline or cancel an order — for example, where stock is unavailable, an error has occurred, or we reasonably suspect fraud — and if we do, we will refund any payment for that order.

Payment

Payment is due at the time of order, using the methods shown at checkout and processed securely by our third-party payment providers. We do not collect or store your full card details. Goods remain our property until paid for in full.

Stock availability

Occasionally an item may sell out or become unavailable after you order. If this happens, we will contact you to arrange a backorder, an alternative, or a refund.

Shipping and delivery

We ship within Australia. Delivery costs and any conditions are shown at checkout and on our Shipping page. Delivery timeframes are estimates only. Risk in the goods passes to you on delivery to the address you provide.

Your consumer guarantees under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. For a failure that does not amount to a major failure, you are entitled to have the problem remedied in a reasonable time; if that is not done, you may seek a refund or replacement. These rights are in addition to any manufacturer’s warranty.

Returns, refunds and change of mind

Faulty goods are remedied in accordance with the Australian Consumer Law and any applicable warranty. Because of the nature of thermal optics, we do not generally offer change-of-mind returns; where a return is accepted, conditions apply. Warranty and local service

Our products carry the manufacturer’s warranty and are distributed and serviced in Australia by C.R. Kennedy. If something needs attention, your optic is assessed and repaired here in Australia rather than sent overseas. Warranty details are set out on our Warranty page.

Intellectual property

All content on this website — including text, images, logos and design — is owned by us or our licensors and is protected by law. You may not copy, reproduce or use it without our permission, except as allowed by law.

Using our website

You agree to use our website lawfully and not to interfere with its operation, security or other users. We may suspend or withdraw access if you misuse the site. Our website may contain links to third-party sites, which we do not control and are not responsible for.

Our liability

Nothing in these terms limits your rights under the Australian Consumer Law or any other non-excludable law. To the extent permitted by law, our liability in connection with any product or the website is limited, at our option, to replacing or repairing the goods, resupplying the service, or paying the cost of doing so; and we are not liable for indirect or consequential loss.

Privacy

We handle your personal information in accordance with our Privacy Policy.

Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland.

If a dispute arises

If you have a concern, please contact us first — most issues are sorted out quickly and fairly, and we will work with you in good faith to resolve any dispute.

Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one published when you place it. The current version is always available here.

Severability

If any part of these terms is found to be invalid or unenforceable, the rest continues to apply.
